  The controller is obliged to make any effort to  provide means of physical, technical and organizational protection of personal data against its accidental or intentional damage, accidental loss, change, unauthorised disclosure, using or accessing – in compliance with all legislations in force. 
  The crucial information about legal basis for processing personal data, its ways of collecting and using and also about rights of the data subjects are presented in this document. The document applies to all cases in which Henkell Freixenet Polska
Sp. z o.o. is the controller of personal data and processes personal data. It refers to both cases, when we process personal data which are obtained from a person and when personal data are obtained from other sources.
   
  Purposes and legal basis for processing personal data:


Your personal data can be processed in the following purposes and based on legal basis:

1. Answering your questions and contacting with you because you have asked us by using contact form or sending an e-mail. The legal basis for processing data is the legitimate interest of the controller (art. 6 para. 1 letter f GDPR) that based on the need of responding.
  2. Contacting with you on current matters particularly on agreements between our company and you or a person that represents your company, and on presenting offers, receiving orders and commissions, answering the questions.

3. Realization of agreements between our company and you or a person that represents your company, including accepting and processing the orders, ordering, contracting, performing accounting activities, accounting service,
debt collection.

The legal basis for processing data is necessary for the performance of a contract or in order to take steps before the conclusion of the contract with you (art. 6 para. 1 letter b GDPR), and also our legitimate interest (art. 6 para. 1 letter f GDPR) based on the need of proper realization of agreements with customers.
  4. Informing you through Newsletter about planned events, competitions and new in our offers. The legal basis is your willingness to agree on processing your personal data and receiving such information by electronic means in understanding of act of providing services by electronic means (art. 6 para. 1 letter a GDPR). 
  5. Safety assurance of using websites, matching them to the needs of users, marketing of own services and products. The legal basis is a legitimate interest of the controller
(art. 6 para. 1 letter f GDPR) based on the need of assuring safety while using websites and providing comfortable use of them as well as possible providing offers of own services and products to the customer.
  6. Fulfilment of legal obligation that is incumbent on us particularly based on regulation of tax law. The legal basis is the need of fulfilment of legal  obligation that is incumbent on the controller (art. 6 para. 1 letter c GDPR).
  7.  Determining, securing and pursuing possible legal claims both on our side and yours. The legal basis is the legitimate interest of the controller (art. 6 para. 1 letter f GDPR) based on possible determining and pursuing legal claims or defending against legal claims. 
  Recipients of the data:
Your personal data can be shared with our external persons cooperating with us, providing services to us, and with whom we may conclude a contract on entrusting the processing of personal data.
These persons are our IT service providers, post office workers and deliverymen and persons providing legal or audit services. In addition to the persons mentioned, your data can only be shared with authorised persons under the rules of national law or EU law. Your personal data must not be shared with countries that are not member of the European Union. The controller is very careful in order to secure your personal data, particularly to save it against unauthorised people.



Data retention of personal data:
We are obliged to retain your personal data during the essential period to achieve the purposes mentioned above. If:

1. Your personal data are processed in connection with a contract conclude with you or the person who represents you, we will retain it for duration of the contract and – when it is necessary – for a period of 5 years, starting from 1st of January following the date of the last event related to implement of the contract. 

However, the controller of data can retain limited part of data in order to show the compliance with regulations. The statutory obligations in the frame of data retention specified in the rules of civil and tax law are significantly important here. 
  2. You contact with us, your data will be processed for a period of 3 years from the end of contract. 
  3. We process personal data on based of your approval, this data will be retained until it is withdrawn.
If your personal data is not essential any more to purposes for which it is processed, we will process it in order to determine, pursue or defend against possible legal claims both on your and our side only for period of limitations of legal claims specified in legal regulations.
  Consequences of not providing the personal data:
Apart from cases where providing the personal data is obligatory, providing it is completely voluntary, however, not providing it may inhibit or prevent realization of purposes mentioned above.
  Rights of the data subject:
We guarantee the respect of your rights based on regulations of GDPR.
You have the right to access your data and to correct it, delete it, limit the processing, transfer the data, withdraw the approval at any time, but the withdraw does not have an impact on lawfulness of the processing which were made before the withdrawal. You have the right to make an complaint referring to our processing of your personal data to the supervisory organ, i.e. Personal Data Protection Office, address:  ul. Stawki 2, 00-193 Warszawa.
  Information about an automated decision making:
In relation to your personal data given to us, we neither use the automated decision making nor profiling.
